Terms of Service

1. Agreement to Terms
By accessing or using the services of Med Spa Web Designs ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
We provide web design and development services exclusively for medical spas, plastic surgeons, and aesthetic injectors. Services include website design, development, deployment, and optional maintenance. A detailed scope of work is provided in each project proposal.
3. Payment Terms
Our standard pricing is a flat fee of $4,999 per website build. Payment is due in full prior to project commencement. Custom packages, add-on services, or ongoing maintenance are quoted separately and invoiced according to the agreed schedule. We do not require ongoing retainers unless explicitly agreed to in writing.
4. Client Responsibilities
Clients are responsible for providing all necessary content, including but not limited to: brand assets, treatment descriptions, provider bios, photography, and legal compliance information. Timely review and feedback is essential to maintaining the 30-day delivery timeline. Delays in client feedback may push the launch date.
5. Intellectual Property
Upon full payment, clients receive 100% ownership of their website code, content, and design assets. We retain the right to showcase completed work in our portfolio. Our proprietary platform architecture, templates, and frameworks remain our intellectual property and may be used for future client projects.
6. Medical & Legal Compliance
Clients are solely responsible for ensuring their website content complies with applicable medical board regulations, HIPAA, state advertising laws, and FDA guidelines. We build HIPAA-compliant technical architecture, but clients bear responsibility for all medical claims, before-and-after disclosures, and treatment descriptions published on their site.
7. Limitation of Liability
Med Spa Web Designs shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability under these terms shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
8. Termination
Either party may terminate the agreement with written notice. In the event of termination, the client retains ownership of any work product completed and paid for to date. Outstanding invoices remain payable.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
